        Rules of the Beach

 

Sec.29-17 Public profanity and intoxication: possession of open alcoholic beverages containers in public parks, playgrounds, and public streets prohibited.

If any person profanely curse or swear or be intoxicated in public, they shall be deemed guilty of a Class 4 misdemeanor.

it shall be unlawful for any person to possess any open alcoholic beverage containers in the public parks, playgrounds or public streets in the city.  Any person violating the provisions of this section shall be guilty of a Class 3 misdemeanor.

Sec. 25.2-44 Building fires; dropping matches, cigarettes, etc.

No person shall build nor attempt to build a fire in a park, except in such areas and under such regulations as may be designated by the director consistent with the city fire prevention code.

No person shall drop, throw or otherwise scatter lighted matches, burning cigarettes or cigars, tobacco paper or other inflammable material within any park area or on any road or street abutting or contiguous thereto.

Sec. 25.2-32 Domestic animals generally.

All dogs and domestic animals shall be restrained on a leash at all times when in a public park.

No dogs or domestic animals shall be permitted upon public beaches during the period of April 15 thru September 30 of each year, between the hours of 9:00 am and 7:00 pm daily.

Sec. 25.2-161.1 Glass containers on beaches.

No person shall carry onto the beaches of the city glass containers on any kind or use any such containers while on such beaches.

Sec. 25.2-161.1 unlawful entry on rock jetties, groins or stormwater pipes or conduits.

It shall be unlawful for any person to go upon, or attempt to go upon any rock jetty, groin or stormwater pipes or conduit built, constructed or maintained by the city adjacent to the beach or extending from the beach into the water.  A violation f this section shall constitute a Class 1 misdemeanor.

Sec. 25.2-25 Regulations for swimming areas.

No person shall swim, bath or wade in any waters or waterways in or adjacent to any park, except such waters and at such places and times as are provided therefore and in compliance with the provisions of this section.

No person shall frequent any waters of places customarily designated for the purpose of swimming or bathing in or adjacent to a park, or congregate thereat, when the beach area is closed by the director upon finding that such use of the water would be dangerous or otherwise inadvisable

No person shall frequent any waters of places y designated for the purpose of swimming or bathing in or adjacent to a park, or congregate thereat, except between such hours of the day as shall be designated by the director for such purposes for each individual area.

No person shall erect, maintain, use or occupy, on or in any beach or bathing area in or adjacent to a park, any tent, shelter or structure of any kind not placed on the beach by the department.

No person shall dress or undress on any beach, or in any vehicle, toilet or other place in a park, except in such bathhouses or structures as may be provided for that purpose.

 

 

 

Sec. 6.1-72 Allowing animals to defecate on
public property or on private property of other persons

It shall be unlawful for any owner or person in control of any animal to allow any animal to defecate on the property of other persons without their consent of that of the authorized agent or persons having control of the premises or on public property.  Immediate removal and sanitary disposal of the defecated matter shall not constitute a violation of this section.  The defecated matter shall be placed in a container and disposed of in a proper waste receptacle.  A violation of this section shall constitute a Class 3 misdemeanor.

Sec. 25.2-173 Sleeping on beaches and shores of Chesapeake Bay and Willoughby Bay.

It shall be unlawful for any person to sleep on the beaches or shores of the Chesapeake Bay between the western end of Willoughby pit on the west and the city limits on the east, in the city, between the hours of 8:00 pm and 8:00 am.

Sec. 29-16.1 Urinating, etc. in public.

It shall be unlawful for any person to urinate or defecate on any public street, alley, sidewalk, park, beach or other public place or area where the public gathers or has access, other than in facilities designed for such purpose.  Any person violating the provisions of this section shall be deemed guilty of a class 3 misdemeanor.
